What Makes Intersection Accidents So Complex?

March 25, 2023
By Lafferty Gallagher Scott

Intersections are sometimes very difficult for drivers to navigate. With traffic coming from three or four directions, accidents between motorists, truck drivers, bicyclists, and pedestrians are much more likely to happen. Intersection accidents can result in serious injuries that affect victims for the rest of their lives. Intersection accidents are different from other crashes on the road, and they are often much more complex. Below, our Ohio car accident lawyer explains the challenges involved and how to overcome them.

The Types of Intersection Accidents are More Complicated

There are many different types of accidents that occur in intersections, and the very nature of these crashes can make a case more complicated. The most common types of intersection accidents include:

  • T-bone accidents: A T-bone intersection accident can occur when a motorist runs a stop sign or red light or when they carelessly turn left.  A T-bone accident occurs when one driver crashes into the side of another vehicle. Determining liability in these crashes is not easy, as it is not always the driver who crashed into another vehicle that is at fault.
  • Rear-end accidents: Most people believe that when a driver hits another vehicle from behind, they are always liable for paying damages. This is not always true, though, and determining liability can become quite complex.
  • Head-on collisions: Of all the different types of accidents, head-on collisions are some of the most deadly. They can also happen very easily in an intersection. These crashes occur when the fronts of two cars crash into each other. It is not always easy to determine what negligent act caused this type of crash to happen.
  • Sideswipes: Sideswipe accidents occur when the sides of two vehicles collide with each other, usually during lane changes. In intersections, these accidents can also involve cyclists and pedestrians, which will always make filing a claim more complicated.

Comparative Law in Ohio Makes Intersection Accidents More Complex

Liable parties, and the insurance companies that cover them, often take advantage of Ohio’s comparative fault law after an intersection accident. This law states that when two or more parties contribute to an accident, they can each be assigned a certain percentage of fault. Under this law, accident victims can still file a claim for compensation as long as they were 50% or less at fault. However, any compensation recovered is reduced by an accident victim’s same percentage of fault.

Due to the fact that intersection accidents often involve multiple parties, insurance companies will usually argue that injured individuals are partly at fault. This makes obtaining the compensation you deserve far more challenging.
