Can I Recover Damages for My Whiplash Injury?

Most people have heard of whiplash and rightly associate it with car accidents. However, only car accident victims who suffer from this injury actually understand how painful and debilitating it can be. Those suffering from severe whiplash are often unable to go to work or complete daily tasks without enduring serious pain. What is Whiplash?

Whiplash is a term used to describe the stretching or tearing of the ligaments or muscles in the neck after the head suddenly jerks forward or backward as a result of an outside force. Symptoms range from minor to severe, but anyone experiencing the following problems after a car accident should immediately seek medical attention:

  • Dizziness;
  • Headaches starting at the base of the skull;
  • A loss of range of motion in the neck;
  • Numbness or tingling in the hand;
  • Blurred vision;
  • Muscle Spasms;
  • Ringing in the ears; and
  • Chronic pain.

Some whiplash victims fully recover within a few weeks or months of their accident, others can take years.  Unfortunately, many people are not aware that they are suffering from whiplash until well after the injury occurred, which can make it difficult to treat. In fact, it is not uncommon for whiplash symptoms to manifest until many days after an accident.

Medical Costs

The treatment recommended for a whiplash victim will depend on the patient’s age, sex, and general health. For example, some victims require help with pain management and must regularly take prescription medications or receive injections of lidocaine, while others benefit from physical therapy and professional massage. Unfortunately, reaching a diagnosis is not always easy or cheap and many victims end up spending thousands of dollars on a series of diagnostic tests, including CT scans and MRIs. Paying for examinations and treatment can quickly overwhelm a victim’s finances, even those with access to insurance. Fortunately, when an injury can be traced to another person’s negligence or reckless conduct, that individual can be required to compensate the victim for the following expenses:

  • Past and future medical expenses, including rehabilitation;
  • Lost wages incurred while recuperating from the injury;
  • Loss of future income if the injured party is disabled as a result of the accident;
  • Repair or replacement of damaged property; and
  • Pain and suffering endured by the victim.

The amount that an injured party receives will depend on the amount paid in medical bills, his or her income, and whether he or she contributed to the accident in any way.
