A family whose son was killed during a police stop has filed a civil lawsuit against the city, police department and the officer involved in the stop. The family’s allegation is that the police officer used excessive force during the stop, resulting in their son’s death.
There has been an overwhelming number of reports recently regarding police brutality and excessive use of force. Most of these incidents have resulted in catastrophic injuries to the victim, including death. And even though criminal charges are rarely successful against the officers, the burden of proof in a civil matter is much lower than in criminal matters. In criminal cases, the prosecutor must establish his allegations against the defendant beyond all reasonable doubt, which is a very high burden to satisfy. In civil cases, however, the plaintiff only needs to prove his/her case by a preponderance of the evidence, meaning that the allegations are more likely than not true. To look at it from a percentage standpoint, one could say that “beyond all reasonable doubt” equals 99% certain, where “preponderance of the evidence” equals 51% certain.
