If you have ever had the displeasure of being involved in a car accident, you have also probably had the displeasure of being contacted by numerous attorneys, even without you contacting them first. You may have received a number of letters in the mail with a “free” copy of your accident report (most police departments provide free copies of crash reports on their website), dvds, brochures, etc. You have probably also received phone calls, emails, text messages, and social media contacts from lawyers, again without any request from you. Some of these attorneys and law firms you have heard of. Others you have not. Some of them are local attorneys. Most of them are nowhere near your hometown.

In this electronic age, these attorneys and firms troll the internet, looking for accident reports and news articles about car accidents, and then bombard the injured people with their “advertisement” materials within 24 hours of the accident. Past clients have reported receiving as many as 30 or more of these contacts within a week of their accident, all without ever contacting or seeking out these attorneys.

Despite ethical rules prohibiting attorneys from contacting potential clients directly without first being approached by the client, the Ohio Supreme Court has approved of this practice, so long as the materials are marked “For Advertisement Purposes Only”. The problem with this is that the majority of these so-called “advertisements” that you receive are from attorneys who are not experienced in handling personal injury cases, do not have an office anywhere near you, and/or are unable to provide you with the personal care you need during your difficult time. This practice gives all personal injury attorneys a bad name, and that simply is not fair. The majority of legitimate personal injury attorneys would never participate in such an activity, even if it means that they miss out on a good case.
